Terms and Conditions for the supply of Great Books products

The Contract
a. Any contract for purchases made through the website will be with Great Books, whose registered office is situated at 10, Pavwala bldg, 38/42 Raja Ram Mohan Roy Rd., Grant Road (East), Mumbai 400004, India.
b. Great Books are entitled to withdraw from any contract in the case of obvious errors or inaccuracies regarding the goods appearing on our website. If an error or inaccuracy is discovered with regards to the advertised price of the goods that you have ordered, we will contact you as soon as possible by e-mail. This will be to inform you of the correct price of the goods, and to ask you if you wish to continue with the order at the amended price, or to cancel the order altogether. In case of cancellation, Great books is not liable for damages and/or compensation, if any, arising such situation.
c. Great Books must receive payment in whole of the price for the goods that you order before your order can be accepted, and the contract to be formed. Once payment has been made Great Books will confirm that your order has been received by sending an e-mail to you at the e-mail address provided by you in the registration form. This shipment e-mail will include your name, the order number and the total price. Great Books acceptance of your order brings into existence a legally binding contract between us on these terms. Any term sought to be imposed by you in your order will not form part of the contract.
Withdrawal from the contract
a. To withdraw your order you must notify Great Books in writing at the address set out in the returns section of this website within Seven (7) working days of you receiving the goods. Such good/s should reach us within Ten (10) working days after intimation by you of withdrawal of the same.
b. The only circumstance in which you cannot withdraw your order is where you have taken the goods you have ordered (or the ones in relation to which you want to withdraw) out of the sealed package in which they were delivered.
c. If you have received the goods before you withdraw your order then, unless you have lost your right to withdraw (i.e. you have taken the goods out of their sealed package), you must send them back to the Great Books return address at your own cost and risk. If you withdraw your order but Great Books has already processed the goods for delivery and you have received them, you must not unpack the goods when they are received by you and you must send the goods back to Great Books at the Great Books return address at your own cost and risk.
d. Once you have notified Great Books that you are withdrawing your order, Great books shall re-credit the payment by means of a cheque issued in your favour by Great books as soon as possible and in any event within 30 working days of your withdrawal order.
e. Great Books will not be obliged to offer any compensation for disappointment suffered.
Your details
a. When you register with the Great Books website, you will be required to choose a contact e-mail address and password. You are responsible for all sessions and transactions taken under these details. You should keep your password safe and not disclose it to anyone. You should change it immediately if you feel it has been compromised.
b. If any of your details change, such as your credit card billing address, you must inform Great Books as soon as possible. You may update your details by signing into your account on the Great Books website, and update the relevant section.
Availability of goods you order
If Great Books has insufficient stock to deliver the goods ordered by you, we will notify you as soon as possible by email at the address given by you in your order form. We will wait for your response on whether you are willing to wait till the item is back in stock, and we can then deliver it as soon as possible, or whether you would like to withdraw the order. In case of the latter option, it shall be deemed as a withdrawal of contract from your part and in such the terms and conditions herein applicable shall be of such mentioned in the "Withdrawal from the contract" mentioned above. Great Books will not be obliged to offer any additional compensation for disappointment suffered.
Please Note: In case of multiple items in an order, the items will not be dispatched unless all the items in the order are in stock. If in case one of the items is out of stock (out of the items ordered), the above procedure will be followed and you will be contacted as soon as possible. If you are willing to wait for the item to be back in stock, we will dispatch all the ordered items together, but if you decide otherwise, the rest of the items will be dispatched and the refund of the item which is not in stock will be made by means of a cheque issued by Great Books in your favour.
Please note: We endeavor to bring our customers the best value we can by running special offers, but please remember stocks are limited at the special offer price, and subject to availability. We update our website as quickly as we can to minimise disappointment. The process of updating the website when goods have sold out at promotional price can take a few hours to update. Please note that the price the goods are offered for tender are as displayed in the Shopping Basket. Rest assured your credit card will only be debited as your order or individual items from your order are dispatched.
Payment Details
Any items bought from www.namethebook.com will be invoiced in US Dollars. The site has several currency viewing options, but final invoicing will be in US Dollars as per prevailing currency exchange rate.
Any items bought from www.namethebooks.com, will be invoiced in the name of Great Books.
For any items bought it is mandatory for payment to be made first, irrespective of the mode of payment, whether it is via Credit Card [cc] or a Demand Draft [dd] (for customers in India only). For payments to be made via card the user will be transferred to PayPal website, where the user can make a safe and secure payment and then the user will be returned back to the site to receive a confirmation of order. In case of payment via demand draft (for customers in India only), it should be payable at par to M/s Great Books, and send over to 10, Pavwala Building, 38/42 Raja Rammohan Roy Road, Grant Road (East), Mumbai 400004. DD should reach us for the order to be complete and processed. DD should reach us within 15 working days for the order to be processed, or else the order would be regarded as null and void and Great Books will not be liable for any inconveniences caused. Please note DD should be made inclusive of any Shipping & Handling charges.
Also it is agreed by you that any sort of DD making charges, or courier charges, or other charges, if any, will be borne by you and Great Books will not be liable for any such charges or compensation.
In case of refunds, which you may be liable to, will be made by Cheque issued by Great Books in your favour, and will be posted to you as soon as possible.
Delivery of goods to you
a Great Books will post, or arrange a courier on your behalf, for the goods ordered by you to the person and address you give Great Books at the time you make your order. For goods delivered outside of India, the consignee (i.e the person to whom the consignment is sent) will be the declarant and importer into the country for which the consignment is destined. The consignee will be responsible for both customs clearance and payment of customs duties and local taxes where required.
b. Delivery will be made as soon as possible after your order is accepted and in any event within 30 days of despatch of the order. All delivery times quoted on the web site are estimates only, based on availability, normal processing and delivery companies.
c. You will become the owner of the goods you have ordered when the goods are dispatched to you from our distribution centre.
Customs charges
If you are ordering goods for delivery outside of India, please note that your consignment may be subject to import duties and taxes, which are levied once the goods reach the country of destination. Any such charges levied in relation to customs clearance must be borne by you. It is accepted by you that Great Books has no control over additional charges in relation to customs clearance Great Books recommend that you check with your local customs officials or post office for more information regarding importation taxes/duties that may be applicable to your online order.
Liability
a. If the goods Great Books delivers are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, Great Books shall have no liability to you unless you notify Great Books in writing at the Great Books contact address of the problem within 10 working days of the delivery of goods in question.
b. If you do not receive goods ordered by you within 30 days of the date on which they were dispatched to you Great Books shall have no liability to you unless you notify Great Books in writing at the Great Books contact address of the problem within 40 days of the date on which the goods were dispatched to you.
c. If you notify a problem to Great Books under this condition Great Books only obligation will be, at its option, to make good any shortage or non-delivery; to replace or repair any goods that are damaged or defective; or to refund to you the amount paid by you for the goods in question to the original method of payment, unless such method is no longer valid in which case Great Books e-coupons will be issued to the value of the refund due.
d Great Books will not be liable to you for any indirect or consequential loss or damage arising out of any problem you notify to Great Books under this condition and Great Books shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question under paragraph (c) above.
e. Nothing in this condition is, however, intended to limit any rights you might have as a consumer under applicable local law that may not be excluded nor in any way to exclude or limit Great Books liability to you for any death or personal injury resulting from its negligence.
Nothing in this contract creates any right which is enforceable by any person who is not a party to the contract.
Force Majeure
Great Books shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond its reasonable control.
Invalidity
If any part of these conditions is unenforceable (including any provision in which Great Books excludes its liability to you) the enforceability of any other part of these conditions will not be affected.

Entire Agreement
These terms and conditions, together with the current Great Books website prices, delivery details and Great Books contact details, set out the whole of our agreement relating to the supply of the goods to you by Great Books. These terms and conditions cannot be varied except in writing signed by a director of Great Books In particular nothing said by any sales person on behalf of Great Books should be understood as a variation of these terms and conditions or as an authorised representation about the nature or quality of any goods offered for sale by Great Books. Great Books shall have no liability for any such representation being untrue or misleading.
Disclaimer
Great Books, whose registered office is situated at 10, Pavwala bldg, 38/42 Raja Ram Mohan Roy Rd., Grant Road (East), Mumbai 400004, India, is a company registered and carrying out itsbusiness from the Republic of India. The sale of books/ Contract formed shall be in India & only subject to applicable Indian laws governing such sales. Any disputes, Legal and/or Judicial, shall be subject to Mumbai High court only.
